California ban on same-sex marriage struck down

I'd like to have seen a larger majority in the judges' vote. Too close to the reversible borderline for my preference. Six to one for my side instead of four to three would have been better. :)

The problem I see here is that there is nothing stopping the voters of CA from sending more and more reworded bans through until one sticks legally. As long as a voting majority favors a ban it will ultimately be very difficult to prevent one from happening. That is an unfortunate but necessary aspect of democracy. So the ultimate solution is to win over enough statewide support so that this is not an issue.

The problem with that concept is that the 13th amendment never would have cleared congress if the Civil War wasn't going on at the time - the states that would have blocked it were in rebellion and not voting. So unless we cut the bible belt loose I can't see anything happening on the federal level here anytime soon.

Say, we might be onto something here...

All joking aside, I generally disapprove of the feds ramming legislation into the face of the states, i.e.: DHS trying to force NH into the Real ID bullshi^H^H^H^H program. I'd much rather see the people of California generate enough popular support to overcome the ban on their own. As for Alabama, et. al., just be thankful they can't legally drag you behind their trucks for not going to church.
